Nuovo IMAIE manages and protects neighbouring rights due to performing artists of the music area and the audiovisual area. The Italian Copyright Law (LDA n. 633 of 1941) assigns to performing artists who performed in the realization of a phonographic recording or a cinematographic and/or assimilated work, a series of rights aimed to protect their artistic performances and to guarantee that they obtain an income for the broadcasting, communication to the public and use of their works.
Nuovo IMAIE is the institute in charge to manage and distribute remuneration due to artists of the music and audiovisual area according to certain forms of use of their works in compliance with the law. In particular, artists that made a recording have the right to an equitable remuneration when their recording is broadcasted by radio, TV, internet, or is transmitted or communicated in public places or in any case reused; artists that took part in a cinematographic and/ or assimilated work have the right to an equal remuneration when their work is broadcasted on television, internet and through any digital platform, marketed and rented in any way or by any means, broadcasted and communicated to the public or in any case, economically exploited.
Moreover, Nuovo IMAIE manages and distributes to performing artists audio and video private copying rights to which they are entitled by the law.
Nuovo IMAIE, which institutionally represents and protects rights for the entire artistic category, is the Italian reference speaker in the proper national and international offices for political and legislative discussions in the field of artists’ neighbouring rights and respect of their creativity. Therefore, Nuovo IMAIE is engaged in all necessary activities to promote the adoption of policies and rules aimed to strengthen the protection of performers’ rights including and particularly in the digital area and to guarantee the full observance of neighbouring rights to which they are entitled.
This section is dedicated to a deeper legislative study of the protection of performers’ neighbouring rights of both music and audiovisual areas.
