Nuovo IMAIE-SCF
SCF, Società Consortile Fonografici, which groups the most representative major and independent record producers, collects equal remuneration due to performing artists and producers, with the obligation to pay to Nuovo IMAIE 50% of the collected amount from anyone broadcasting to the public music works:
Radio (air, digital terrestrial, satellite, simulcasting)
TV (air, digital terrestrial, satellite, simulcasting)
Communication to the public (bar, restaurants, public premises, discobar, discos, non-profit bodies and corporations, institutional and territorial bodies, places open to the public, events, gyms, amusement parks, hairdressers, wellness centres, answering machines, accommodation facilities, professional studios)
New technologies (websites sound dubbing, mobile phones, web radio and web TV)
Music service provider (content provider)
Therefore, SCF collects from the above users and pays to Nuovo IMAIE, in compliance with the agreement signed on March 31, 2011, the rights destined to performing artists according to the following scheme:
- rights relative to ex art.s 73 and 73 bis L.d.A. (communication to the public) in relation to URA (Analytical Reports of Utilizations) and to UNAR (Non-analytical Reports of utilizations): 50% of the amount collected from users
- rights relative to ex art.s 71 septies and 71 opties L.d.A. (private copying rights): 50% of the amount collected from SIAE
- rights relative to ex art.s 73 and 73 bis L.d.A. (communication to the public) for backing tracks not for sale: 25% of the amount collected from users
- rights relative to ex art.s 73 and 73 bis L.d.A (communication to the public) for videoclips: 16,66% of the amount collected from users
- rights for simulcasting: 12,25% of the amount collected from users
Record producers that join the agreement take note and accept to send, in compliance with art. 7 of Law 100/10, according to the terms of the agreement, a playlist with all the data requested in the Communication Template prearranged by Nuovo IMAIE.
The present Regulations are effective from July 14, 2009 to December 31, 2011.
Nuovo IMAIE-AFI
AFI (Associazione Fonografici Italiani) represents the small and medium national record producers, video producers, and publishers.
The agreement between Nuovo IMAIE and AFI provides for the payment of:
- rights relative to ex art.s 73 and 73 bis L.d.A. (communication to the public): 50% of the amount collected from users – radio, TV, Fipe (Federazione italiana pubblici esercizi -Italian Federation of public premises) Sapar (National Association Equipment for public recreational attractions Equipment)
- rights relative to ex art.s 71 septies and 71 opties L.d.A. (private copying): 50% of the amount collected from SIAE
- rights relative to ex art.s 73 and 73 bis L.d.A. (communication to the public) for backing tracks not for sale: 25% of the amount collected from users

Nuovo IMAIE – AUDIOCOOP
Audiocoop, coordination between the independent record labels in Italy, is an association of independent Italian record labels, publishers, producers, and self produced artists.
At present negotiations are under way for renewing the agreement signed with IMAIE in Liquidazione on October 31, 2010, that provided for the payment of the period from 2000 to 2007 of:
- rights relative to ex art.s 71 septies and 71 opties L.d.A. (private copying): 50% of the amount collected by SIAE
Nuovo IMAIE – PMI
PMI (Produttori Discografici Indipendenti) groups Italian record producers determined to support the rights of independent production.
At present negotiations are under way for renewing the agreement signed with IMAIE in Liquidazione that provided for the payment of the period from 2000 to 2007 of:
- rights relative to ex art.s 71 septies and 71 opties L.d.A. (private copying): 50% of the amount collected by SIAE
Nuovo IMAIE – Producers not associated to any category institution
In order to receive the remuneration for rights ex articles 73 and 73 bis (communication to the public) from all phonogram producers, Nuovo IMAIE asked RAI and RTI, a list of producers and their associations, except for AFI and SCF, to which the two broadcasters pay equitable remuneration directly. The same request was made to SIAE for private copying rights.
